Please read these terms carefully before using PapelShip. By using our Service, you agree to be bound by these terms.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PapelShip ("we," "us," or "our") governing your access to and use of the PapelShip platform, including our website, API, mobile applications, and all related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
2. Description of Service
PapelShip is a comprehensive platform that provides two integrated services:
2.1 PapelShip Storefront
PapelShip Storefront is a digital storefront system that enables users to:
- Create and customize online stores
- List and sell digital products and services
- Accept payments through multiple payment methods, including cryptocurrencies and traditional payment gateways
- Manage product inventory, pricing, and descriptions
- Process orders and transactions
- Access analytics and reporting tools
2.2 qPapel License Management
qPapel is an enterprise license management system that provides:
- License key generation and distribution
- Real-time license validation through API integration
- Hardware identification (HWID) binding for license protection
- License usage tracking and analytics
- Reseller management and commission tracking
- Fraud detection and prevention
- Multi-language SDK support (JavaScript, Python, C#, PHP, Go, and more)
- API access for license validation in applications
The Service may be provided through various subscription plans, including free and paid tiers, each with different features and limitations as described on our pricing page.
3. User Accounts and Registration
To access certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Be at least 18 years old (or the age of majority in your jurisdiction)
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.
You may not create multiple accounts, transfer your account to another person, or use another person's account without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Payment Terms
4.1 Commission Fees
PapelShip operates on a commission-based model. When you sell products or services through the PapelShip Storefront, we charge commission fees as follows:
- Free Plan: 1.49% commission on cryptocurrency transactions, 1% commission on POS (Point of Sale) transactions
- Vaultie Plan: 0.69% commission on cryptocurrency transactions (save 0.80%), 0.49% commission on POS transactions (save 0.51%)
- PapelShip+ Plan: 0% commission on cryptocurrency transactions (save 1.49%), 0% commission on POS transactions (save 1%)
Commission fees are automatically deducted from each transaction. Subscription plans may unlock lower commission rates. All fees are displayed before you complete a transaction.
4.2 Subscription Fees
qPapel license management features are available through subscription plans:
- Vaultie Plan: 20 EUR per 3 months
- PapelShip+ Plan: 40 EUR per 3 months
Subscription fees are billed in advance for the subscription period. Subscriptions automatically renew unless cancelled before the renewal date.
4.3 Payment Methods
We accept various payment methods, including:
- Cryptocurrencies (Bitcoin, Ethereum, Litecoin, Monero, Tron, USDT, USDC, and others)
- Credit and debit cards (processed through Stripe, PayPal, WeePay, and other payment processors)
- Other payment methods as may be available from time to time
All payments are processed securely through third-party payment processors. We do not store full credit card numbers or sensitive payment credentials.
4.4 Refunds
Refund policies vary depending on the type of transaction:
- Subscription Fees: Subscription fees are generally non-refundable. However, we may provide refunds on a case-by-case basis for unused portions of subscriptions in exceptional circumstances.
- Product Purchases: Refund policies for products purchased through PapelShip stores are determined by individual store owners. Please refer to the store's refund policy before making a purchase.
- Commission Fees: Commission fees are non-refundable once a transaction is completed.
To request a refund, please contact our support team. Refund requests will be evaluated on a case-by-case basis in accordance with applicable laws and our refund policy.
4.5 Currency and Pricing
All prices are displayed in the currency specified by the store owner or in the default currency for your region. Cryptocurrency prices may fluctuate, and we are not responsible for any changes in cryptocurrency values between the time of purchase and payment processing.
We reserve the right to change our pricing at any time. Price changes will not affect transactions that have already been completed.
5. License Key Management and Usage
If you use qPapel license management services, the following terms apply:
- License Ownership: License keys generated through qPapel are owned by the account holder who created them. You are responsible for the security and proper use of your license keys.
- License Distribution: You may distribute license keys to end users in accordance with your own terms and conditions. However, you may not resell, redistribute, or transfer license keys in violation of these Terms or applicable laws.
- API Usage: API usage is subject to rate limits and fair use policies. Excessive API usage may result in temporary or permanent restrictions on your account.
- License Validation: License validation is performed in real-time through our API. We are not responsible for any issues arising from network connectivity problems or API unavailability.
- Hardware Binding: When hardware identification (HWID) binding is enabled, license keys are tied to specific hardware. You are responsible for managing hardware changes and license transfers.
- Fraud Prevention: We implement fraud detection measures to protect license keys. Suspected fraudulent activity may result in license key revocation or account suspension.
You agree not to attempt to circumvent, reverse engineer, or tamper with our license validation system. Any such attempts may result in immediate termination of your account and legal action.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Infringe upon intellectual property rights of others
- Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks
- Use the Service to transmit viruses, malware, or other harmful code
- Engage in any form of automated data collection (scraping, crawling, etc.) without our express written permission
- Use the Service for any fraudulent or deceptive purpose
- Resell or redistribute the Service without our express written permission
- Reverse engineer, decompile, or disassemble any portion of the Service
- Circumvent or attempt to circumvent any security measures or access controls
- Use the Service to compete with us or to develop competing products or services
We reserve the right to investigate violations of these Terms and may take appropriate legal action, including but not limited to reporting violations to law enforcement authorities.
7. Intellectual Property Rights
The Service, including its original content, features, functionality, design, logos, trademarks, and software, is owned by PapelShip and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any content you create, upload, or submit through the Service (your "User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Service.
You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
8. Service Availability and Modifications
We strive to provide reliable and uninterrupted service, but we do not guarantee that the Service will be available at all times or free from errors, defects, or interruptions. The Service may be unavailable due to:
- Scheduled maintenance or updates
- Unforeseen technical issues or failures
- Third-party service disruptions
- Force majeure events
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent, illegal, or harmful activity
- Non-payment of fees
- Extended periods of account inactivity
- Requests by law enforcement or government agencies
Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data, including but not limited to:
- User content and uploaded files
- Store information and product listings
- License keys and associated data
- Transaction history and records
You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, you remain responsible for any fees or charges incurred prior to termination.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAPELSHIP, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAPELSHIP ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY:
- Errors, mistakes, or inaccuracies of content
- Personal injury or property damage resulting from your access to or use of the Service
- Unauthorized access to or use of our servers and/or any personal information stored therein
- Interruption or cessation of transmission to or from the Service
- Bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
- Errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
- User content or the defamatory, offensive, or illegal conduct of any third party
IN NO EVENT SHALL PAPELSHIP'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
11. Dispute Resolution
If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally. If we are unable to resolve the dispute within sixty (60) days, you agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms or the Service through binding arbitration.
Arbitration shall be conducted in accordance with the rules of a recognized arbitration organization. The arbitration will be conducted in the English language, and the arbitrator's decision will be final and binding.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of [Jurisdiction], and you hereby consent to the personal jurisdiction and venue of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
13. Hosting Provider Information
Our Service is hosted on secure cloud infrastructure provided by certified hosting providers. These providers are contractually obligated to maintain high standards of security, availability, and data protection. Data is stored in secure data centers with physical and digital security measures in place.
While we strive to ensure service availability, we are not responsible for any disruptions, outages, or issues arising from our hosting providers' infrastructure. For specific information about our hosting infrastructure and data center locations, please contact us using the information provided in Section 14.
